Terms of Service

These terms govern your use of the Giftyr app and giftyr.app. By creating an account or using a shared wishlist, you agree to them. If you do not agree, please don't use Giftyr.

Who we are

Giftyr is operated by Johannes Meißner. You can reach us at contact@giftyr.app, and the support page explains how to get help.

What Giftyr does

Giftyr lets you keep a wishlist, organise wishes by occasion, and share them with family and friends. People you share with can reserve a gift so two of them don't buy the same thing — without the person the gifts are for ever seeing who reserved what. That privacy property is the point of the product, and we treat attempts to defeat it as a violation of these terms.

There is one deliberate exception, and it runs the other way. When you create an occasion for someone else — organising a birthday for a friend who isn't on the list — everyone taking part, you included, sees who is giving what. There is no surprise to keep among the givers; the only person to protect is the one receiving, and they aren't there. If you share such an occasion by link, anyone holding that link sees the same attribution, so share it deliberately.

Your account

You sign in with Apple. You're responsible for what happens under your account. Giftyr is not intended for children — you must be 16 or older to create an account. A parent or guardian can of course maintain a child's wishes on their own adult account.

You can delete your account at any time in the app under Profile → Privacy → Delete account. Deleting removes your account and its content; see the privacy policy for what that covers and how long it takes.

Your content

What you add stays yours. Wishes, photos, notes, occasion names, circle names and comments belong to you. You grant us only the permission we need to run the service: to store your content and show it to the people you have shared it with.

You're responsible for what you post, and for having the right to post it — including any photo you upload. Don't add anything unlawful, or anything that infringes someone else's rights.

Share links

A share link is public to anyone who has it. There is no password on it: anyone you send it to can open it, and so can anyone they forward it to. Share links with people you trust, and treat the contents as visible to whoever receives the link.

Acceptable use

Don't use Giftyr to:

• post unlawful, hateful, harassing, deceptive or sexually explicit content;
• impersonate another person, or misrepresent who you are;
• harass or abuse other people through comments, circle names or wish content;
• attempt to discover who reserved a gift on an occasion whose gifts are for you, or otherwise work around the reservation privacy model;
• access other people's data, probe or disrupt the service, or scrape it automatically.

If you come across content that breaks these rules, report it in the app or tell us at contact@giftyr.app and we will look into it. We can remove content and suspend accounts that violate these terms.

Links to shops and other sites

When you add a wish from a link, Giftyr fetches a title, image and price from that page so the wish looks like the thing you want. Those shops are not ours. We don't endorse them, we're not part of any purchase you make there, and we can't vouch for their prices, availability or accuracy. Anything you buy is strictly between you and that seller.

Availability

Giftyr is free to use. We may change, suspend or discontinue features, and we don't promise uninterrupted or error-free service. We'll give reasonable notice before any change that would significantly affect how you use the app.

Ending these terms

You can stop using Giftyr and delete your account at any time. We may suspend or close an account that breaches these terms, or where we're required to by law. If we close your account other than for a breach, we'll tell you why where we're allowed to.

Liability

We are fully liable for damages caused intentionally or by gross negligence, for injury to life, body or health, and wherever liability is mandatory by law — including under the German Product Liability Act (Produkthaftungsgesetz).

For slight negligence, we are liable only where we breach an obligation that is essential to performing this agreement and that you may reasonably rely on us to meet (a Kardinalpflicht), and then only for foreseeable damage typical of this kind of agreement. Any further liability is excluded.

Nothing in these terms limits rights you have as a consumer that cannot be limited by agreement.

Changes to these terms

We'll update this page if the terms change, and the date at the top will tell you when. If a change materially affects your rights, we'll let you know in the app or by email before it takes effect.

Governing law

German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you're a consumer resident in the EU, you keep the protection of any mandatory provisions of the law of your country of residence.

We are neither obliged nor willing to take part in dispute-resolution proceedings before a consumer arbitration board.
